Heard the Learned Advocates appearing for the parties. Following order is passed by consent.
(i) The Marriage Petition No.470 of 2008 filed by the Respondenthusband pending before the Family Court at Nashik shall be withdrawn by the Respondent and liberty is granted to the Respondent to file a fresh suit seeking divorce on all the grounds available to him under the law. (ii) In the event of a fresh suit being filed by the Respondent seeking dissolution of marriage between the Applicant and the Respondent, the same shall be decided without being influenced by any observations/findings recorded in the
kpd 2 / 2 17-SA-206-2016.sxw decision of the Trial Court dated 20.07.2010 in Marriage Petition No.470 of 2008, and the same shall be disposed off within a period of one year from the date of its filing. 3.
The letter of the Respondent addressed to his Advocate is taken on record and marked 'X' for identification.

The above Second Appeal as well as the Civil Application are accordingly disposed off.
