Heard. Application is filed for bail during the pendency of above appeal.

By the judgment and order dated 31st August 2016, the learned Additional Sessions Judge, Barshi has convicted the Applicant herein along with accused no.1 for the offence punishable under section 302 read with 34 of the Indian Penal Code, 1860 and sentenced them to suffer rigorous imprisonment for life. The appeal filed by the Applicant is already admitted. 3.
During the pendency of trial, the Applicant was on bail. However, subsequent to the impugned judgment and order, she was taken into custody. The Applicant being lady coupled with the fact that appeal is not likely to reach for final hearing in near future, we are inclined to release the Applicant on bail patilsr 1 / 2
during the pendency of above appeal. Accordingly, we dispose of this application by passing following order : -: O R D E R :- The substantive sentence awarded to the Applicant under the judgment and order dated 31st August 2016 is hereby suspended. The Applicant be released on bail on the same terms and conditions as were imposed by the trial Court while granting bail during trial. However, the Applicant shall furnish fresh bonds. The Applicant shall remain present in this Court at the time of final hearing of appeal.
