By the impugned order, hearing of the application under section 391 of the Code of Criminal Procedure has been postponed till the final hearing of the appeal by the learned Sessions Court. 2.

Apprehension expressed by the petitioner that the Appellate Court may not decide the application is unfounded. The learned Sessions Judge shall decide the application under section 391 of the Code of Criminal Procedure at the time of final disposal of the appeal and the order on the said application shall be passed before delivering the final judgment in Appeal No.142 of 2020. 3.
