The allegation in the complaint which prompted the authorities to invoke the provisions of the POCSO Act is to the effect that the complainant alleged that in the scuffe, which took place on the date of incident, the complainant and his sister were pushed and the apparel of his sister was torn. This is the allegation pertaining to the POCSO Act, apart from invocation of Sections 8 & 12 of the POCSO Act, Sections 143, 144, 147, 148, 149, 323, 324, 326 and 504 of the IPC are invoked in the said C.R.

Considering this aspect of the matter, on 10/10/2019, the applicants were admitted to the interim protection. By the said order, the applicants were directed to report to the Investigating Offcer on 17th and 18th October, 2019 and M.M.Salgaonkar

2/2 6 ABA-2210-19.doc thereafter as and when called for. The said order continues to operate till date. Today, none appears for the applicants. Learned APP also do not make a statement that the applicants have not co-operated with the investigation.

In such circumstances, order dated 10/10/2019 is made absolute on the same terms and conditions.
