Notice was issued to the respondents and, accordingly, the learned counsel has tendered an affdavit of service on record, which indicate that the service has been effected on the respondents. The affdavit is taken on record. 2.

Heard the learned counsel for the applicants and perused the application, which seeks condonation of delay. M.M.Salgaonkar

2/2 29 CAF-4692-16.doc Paragraphs 4 and 5 justify the delay, which in my opinion, is bona fde and will not cause any prejudice, if condoned. The application is, therefore, allowed in terms of prayer clause (a). 3.

The Registry is directed to allot registration number to the First Appeal and list it after vacation alongwith the application for stay.
