1) Heard. This is an application under section 438 of the Code of Criminal Procedure, 1973. Applicant herein is apprehending his arrest in crime no. 214 of 2016 registered at Narayangaon Police Station for offence punishable under section 363 of the Indian Penal Code.

2) Upon considering the merits of the matter, applicant was granted adinterim relief vide order dated 15/11/2016 and was directed to report to Narayangaon Police Station from 21/11/2016 to 24/11/2016. The learned APP upon instructions submits that the applicant has attended the police station ism

2 23.1920.16 aba and has co-operated with the investigating agency. It is in these circumstances that the custodial interrogation would not be imperative. The order dated 15/11/2016 deserves to be confirmed on same terms and conditions.

O R D E R

(i) Application is allowed.

(ii) In the event of arrest, applicant be enlarged on bail on furnishing P.R. bond in the sum of Rs. 25,000/- with one or more sureties in the like amount. (iii) Applicant shall report to the Narayangaon Police Station as and when called, only after issuing a notice under section 160 of the Code of Criminal Procedure, 1973.

(iv) Application stands disposed of.
