In Crime No. 407/2018 registered with Sangli City Police Station for offence punishable under Sections 4(B) and 5(3)(4) of the Medical Termination of Pregnancy Act, 1971, applicant is seeking pre-arrest bail. Applicant, a public servant serving with New Bombay Municipal Corporation.

The prosecution case against the applicant is, he is permitted his sister-co accused in the aforesaid crime, use of his medical registration certificate.

2 918.2050.18 aba.doc So far as the main acquisition in the offence is concerned, same are against Dr. Rupali Chougule who was already arrested on 17/09/018 and the charge-sheet in the matter is filed. That being so, custodial interrogation of the applicant is not warranted. Hence, following order:

(A) In the event of arrest of the applicant in Crime No. 407/2018 registered with Sangli City Police Station, applicant be released on bail on furnishing P.R. bond in the sum of Rs. 25,000/- with one surety in the like amount. (B) Applicant shall not influence witnesses or tamper with evidence.

(C) Applicant shall attend Investigating Officer on 11/02/2019, 16/02/2019, 18/02/2019 and 23/02/2019 between 10.00 a.m. to 12.00 noon and thereafter as and when directed by the Investigating Officer.

(D) Applicant shall co-operate with the investigating agency.

Application stands disposed of.
