Heard learned counsel for the parties.

By this application, the applicant seeks pre-arrest bail in connection with C.R. No. 88 of 2016 registered with the Park Site Police Station, Vikhroli, Mumbai, for the alleged offences punishable under Sections 354A, 323, 324, 342, 506(ii), 182, 120B r/w 34 of the Indian Penal Code and under Sections 8 and 12 of the Protection of Children from Sexual Offences Act.

Perused the papers. The allegations as against the applicant is that at her instance, the victim girl lodged a false complaint against her father.

aba.2212.19.939.doc The applicant has reported to the concerned Investigating Officer as directed vide interim order dated 11th October 2019. In the facts, custodial interrogation of the applicant is not warranted. Accordingly, the interim order dated 11th October 2019, is confirmed on the following terms and conditions :

ORDER

(i) In the event of the arrest, the applicant be enlarged on bail on executing P.R. Bond in the sum of Rs.10,000/- with one or two sureties in the like amount;

(ii) The applicant shall not contact or attempt to influence the complainant, witnesses or any person concerned with the case. (iii) The applicant to cooperate with the investigating agency. The application is allowed in the aforesaid terms and is accordingly disposed of.
