The applicants are apprehending their arrest in Crime No. 591 of 2022 registered at Shirur police station for the offence punishable under Sections 143, 147, 148, 149, 326, 324, 323, 327, 341, 504, 506, 427 of Indian Penal Code.

It is the case of the prosecution that on 31.08.2022 at about 8.00 pm, the present applicant alongwith the other co-accused assaulted the complainant, his father and brother on account of previous dispute.

I have heard the learned counsel for the applicants and the MJ Jadhav 1 / 2
16-ABA-3066-22.odt learned APP for the respondent-State and perused the First Information Report.

Perusal of FIR reveals that there was dispute between the complainant and co-accused- Balasaheb Marne. According to the complainant on account of said dispute co-accused- Balasaheb Marne and co-accused- Nana Kokade assaulted him by stick and iron rod respectively. According to the complainant present applicants assaulted him by fist blows. Considering the role attributed to the present applicants in crime in question and as nothing is to be recorded at their instance, I am inclined to release the applicants on anticipatory bail. Hence, the following order is passed: (i) Application is allowed.
(ii) In the event of arrest of applicants in Crime No. 591 of 2022 registered at Shirur police station for the offence punishable under Sections 143, 147, 148, 149, 326, 324, 323, 327, 341, 504, 506, 427 of Indian Penal Code, they shall be released on bail on furnishing PR bond in the sum of Rs.25,000/- each with one or two sureties in the like amount.
(iii) The applicants shall attend the concerned police station on 9 November 2022 at 11 am and thereafter as and when called and shall cooperate in the investigation.
