The prayer made in the alternative is to direct the State Government to decide the Appeal/Application under Section 257 of the Maharashtra Land Revenue Code, 1966 (Exhibit-G to the Petition). The learned AGP has no instructions as to whether the said Appeal/Application is pending.

Hence, we dispose of the Petition by passing the following order.

ash wp-10899.14 ORDER :

(a) If the Appeal/Application preferred by the Petitioner bearing No.20294 of 2010 is still pending, the State Government shall decide the same as expeditiously as possible and preferably within a period of three months from today;

(b) If the Appeal/Application is already decided, the order passed on the said Appeal/Application be communicated to the Petitioner;

(c) We make it clear that no adjudication is made on the merits of the controversy;

(d) The Petition is disposed of on above terms.
