Mr.Dedhia, the appellant is present in person and seeks liberty to withdraw this arbitration appeal alongwith civil application with liberty to file a arbitration petition under section 34 of the Arbitration and Conciliation Act,1996. 2.

The arbitration appeal is dismissed as withdrawn with liberty to file an arbitration petition under section 34 of the Arbitration and Conciliation Act, 1996. In view of the withdrawal of the arbitration appeal, civil application does not survive and is accordingly dismissed. No order as to costs. 3.

It is made clear that the issue of limitation if any, in filing the arbitration petition under section 34 will be considered by this court at the time of hearing of admission of the arbitration petition if filed by the appellant. [R.D. DHANUKA, J.]
