1] The applicant was granted interim relief by an Order dated 15th November 2016.

2] It is the prosecution case that, the applicant is the owner of Indradeep Agency having official agency to conduct the business of LPG Cylinders at Kalyan. However, at the time of inspection it was revealed that certain LPG Cylinders which were assigned to Indradeep Agency were found at Padgha, Taluka Bhiwandi, District-Thane.

The record reveals that in pursuance of earlier direction, the applicant has attended the Investigating Officer and has co-operated in the process of investigation. It further appears that the Hindustan Petroleum Corporation has addressed a letter to the Office of the Sub-Controller, Rationing, Thane that, there is no illegality found in the enquiry conducted by it against the applicant.

Dond 2/2 aba.1925-2016.sxw 3] After perusing the record of investigation, this Court is of the view that the custodial interrogation of the applicant for further investigation is not necessary. In view thereof, the interim relief granted by an Order dated 15.11.2016 is hereby confirmed.
