It is informed that applicant no.1 (accused no.2) was issued with a notice under section 41-A of Cr.P.C but she has failed to report to the Investigating Officer. Considering the nature of accusations levelled in the complaint which resulted in invoking of sections 406, 448, 506 r/w 34 of IPC, it would be in the fitness of things that all the accused are served with the notice under section 41-A of Cr.P.C within a period of three days from today.

Upon receipt of the notice the applicants shall report to the Investigating Officer within seven days.

2/2 13 ABA 3065.22.doc Upon their appearance the Investigating Officer shall interrogate them and if he arrived at the conclusion that their custodial interrogation is necessary he shall record reasons to that effect and shall also issue 72 hours advance notice in case he is desirous of effecting their arrest.
