By a reasoned Order dated 27.10.2017, the Applicants were granted interim relief.
Perused the first information report and record of investigation. The record indicates that the Applicant Nos. 1 and 2 are not named in the first information report and no overt act is attributed to them. As far as Applicant No.3 is concerned, he is named accused in the first information report and a specific role is attributed to him.
The learned APP submitted that there are antecedents at the discredit of Applicant No.3 Ganesh Bangar.

16 aba 1871-17=.doc In view thereof, the Application preferred by Applicant No.3 Ganesh Bangar is rejected.
As far as, Applicant Nos. 1 and 2 are concerned they are entitled to be protected by pre-arrest bail. Applicant No.1 Santosh Pandurang Shitole and Applicant No.2 Sudam Bhau Desle are granted pre-arrest bail in the following terms and conditions.
Hence, the following order:
i) In the event of arrest of the Applicants in C.R. No. I-101 of 2017 dated 10.07.2017 registered with Murbad Police Station, District Thane, the Applicants shall be released on bail on their furnishing PR Bond of Rs.15,000/- each with one or two local sureties in the like amount. ii) Applicants shall not tamper with the evidence and/or pressurize or threaten the prosecution witnesses.
