CAW 47.14.sxw P.C. :- The learned Counsel for the Respondent Nos.1 and 2 states that he has received written communication from Respondent Nos.1 and 2 that the Respondent Nos.1 and 2 are ready to promote the Petitioner to the post of Senior Clerk in the Secondary Section.

This statement is accepted and the written communication is taken on record and marked 'X'. 3.
Since the concerned post has now fallen vacant in the school of Respondent No.3 in the Civil Application and the Applicant is the senior most, even otherwise there is no impediment in granting the prayer made in the Civil Application, in any case the Applicant herself has sought this relief subject to the outcome of the Writ Petition.

The Civil Application is accordingly disposed off in view of the above statement and directions.

As regard the issue of deemed date of promotion, consequential benefits and other reliefs, the same shall be considered at the time of hearing of the Writ Petition. (N.M. JAMDAR, J.)
