One of the ground urged in this application is that the applicant has been in actual custody for a period of about Eight and half years and including the remission period would be more than Eleven years.

The co-accused Amol Ashok Jadhav had preferred an application for suspension of sentence and grant of bail which has been allowed to be withdrawn by order dated 21.07.2023 with liberty to file fresh application for bail, in the event the appeal is not taken up for final hearing within a period of one year. The applicant is permitted to withdraw this application with liberty to file fresh application for bail urging all the grounds including the ground of long incarceration by July 2023 in the event the appeal is not heard by July 2024.
