Heard Mr.Niranjan Mundargi, learned counsel for the applicant.
Mr.Mundargi submits that this application has been made mainly on the ground of ill-health of the applicant. He also states that application for bail on the medical or health grounds has not yet been made before the trial Court. He submits that it is because the learned Sessions Judge who is seized of the trial is on medical leave since quite some time. Mr.Mundargi submits that in case a direction can be given to the Judge holding charge of the Court of the Sessions Judge to decide such application, if made, he would not press the present application.
Application is allowed.
Tilak 2/3 (902)BA-2196-15 The applicant shall be at liberty to make a fresh application for bail, inter alia, on medical grounds. If such an application is made, the trial Court shall decide the same in accordance with law. If the learned Sessions Judge who is holding the trial would be unavailable to hear such application, the Bail Application shall be dealt with and decided by the learned Judge holding the charge of the Court of the Sessions Judge. Application is disposed of accordingly.
