This criminal application is moved by the applicant for relaxation of condition of attendance with investigating agency i.e. EOW while granting anticipatory bail to the present applicant. He is directed to attend office of EOW at Mumbai, on every Thursday and Friday between 5 to 7 p.m. He was given anticipatory bail on 30/06/2016. In access he is facing prosecution under the charges u/s 420, 465, 467, 468, 471 r/w 120 (b) of IPC. He had approached the learned Sessions Judge, Greater Bombay, for relaxation. However, the learned Judge passed order dated 10/10/2016 rejecting the application and refused the relaxation of

Heard both the parties. The investigating officers from EOW are present in the Court. The learned prosecutor after obtaining instructions from the investigating officers submitted that the statements of nearly 1156 persons are to be recorded, out of which statements of only 23 persons are recorded as they are residing in different states. It is a fraud case in respect of loan amount and it will take time to investigate. Hence he submitted that the conditions should not be relaxed at this stage. 3.

In view of the submissions made by the learned counsel of both the sides I am inclined to relax the conditions after January 2017. Hence following order is passed;

ORDER

(a) The impugned order directing the applicant to remain present before the EOW office of Mumbai on every Thursday and Friday between 5 to 7 p.m. shall continue till 31/12/2016.

3 / 3 (b) The applicant shall attend the office of EOW on every Tuesday and Wednesday between 5 to 7 p.m. from 01/01/2017 upto 31/03/2017 and thereafter he shall attend the office of EOW as and when called and shall cooperate the officers of EOW.
