This is an application for bail. The Applicant is the accused in Crime No.785 of 2021 registered with Bhatri Vidhapith Police Station, Pune City under Section 353, 332, 504, 506, 427 of the Indian Penal Code and Section 184, 130/177, 122/177 of Motor Vehicle Act.

According to the complainant when the applicant was intercepted while proceeding in a car there was an altercation and the informant was assaulted and abused by the Applicant. 3.

The learned counsel for the Applicant states that the Applicant was intercepted for the reason that he was unnecessarily honking according to the complainant. The N.S. Kamble page 1 of 3

learned counsel for the Applicant stated that there was only an altercation and there was no assault or force used in order to deter the public servant from performing his duty.

The Applicant was arrested on 5 December 2021 and he is in jail since then. The learned counsel for the Applicant pointed out that the maximum sentence is 3 years or fine. 5.

The learned Additional Public Prosecutor submitted that the investigation is complete and the charge-sheet will be filed within two weeks. The Investigating Officer vide his reply has given no objection for the release of the Applicant on bail. 6.

The learned counsel for the Applicant states that without admitting the allegations, just in order to show remorse the Applicant is ready and willing to deposit a reasonable amount with the Legal Services Authority.

In that view of the matter the following order is passed.

ORDER

(i) The applicant be released on bail in Crime No.785 of 2021 registered with Bhatri Vidhapith Police Station, Pune City on executing a P.R. Bond in N.S. Kamble page 2 of 3

the sum of Rs.20,000/-with one or two solvent sureties, in the like amount.

(ii) The Applicant shall deposit an amount of Rs.10,000/- with the District Legal Services Authority, Pune.

(iii) The applicant shall not make any attempt to directly or indirectly to contact the victim and shall not otherwise tamper with the prosecution evidence/ witnesses.

(iv) The Criminal Application is disposed of in the aforesaid terms.
