The applicant was admitted to the interim protection by order dated 11/10/2019 on a statement being made that he is willing to pay the amount due and payable to the frst informant, with reasonable interest. Accepting the statement, the applicant was admitted to the interim protection and the complainant was directed to be impleaded as party. 2.

The complainant has responded through learned counsel Mr.Desai, who agree with the learned counsel Mr.Sarda that the dispute between the parties has been settled. Today, Mr.Sarda has tendered on record a copy of the Memorandum of Understanding executed between the parties on 07/08/2021 wherein the parties have referred to the terms of settlement M.M.Salgaonkar

2/2 13 ABA-2228-19.doc and also agreed that they will move the High Court by fling a quashing petition, which will be fled by the applicant and the complainant would give her no objection for quashing the FIR. The applicant has also undertaken to honour the demand draft after fling of the affdavit in support of the quashing petition and when the consent is given to quash the FIR. 3.

In wake of the said settlement effected between the parties and since the applicant was already protected by an interim order, recording the fact that parties are in way of settlement and since the complainant has expressed that her claim is satisfed, order dated 11/10/2019 is made absolute, subject to the same terms and conditions. The applicant shall continue to render his co-operation in the investigation and also take necessary steps to fle the quashing petition at the earliest.
