The learned Counsel for the Petitioners upon instructions seeks liberty to withdraw the present Petition. Liberty as prayed for is granted in the interest of justice.

The learned Counsel for the Petitioners submits that the Petitioners happen to be senior citizen and that they are permanent residents of Chennai and it would cause inconvenience to them to Talwalkar 1/2

The learned Counsel submits that the Petitioners may be granted liberty to file an application seeking exemption and file their affidavit-in reply to the notice through their advocate. The learned Magistrate shall consider the exemption application as well as affidavit in reply on its own merits without being influenced of the fact that the petition has been withdrawn before this Court. The learned Magistrate to proceed with MA No. 839 of 2015 after considering the affidavit filed by the petitioner. Needless to say that the interim relief stands vacated. The Writ Petition stands dismissed as withdrawn and disposed of on the above terms.
