This petition is filed by the sixteen Petitioners praying for a direction that Respondent No.3-the Deputy Director of Education to decide the proposal for approval of the Petitioners' appointment to the post of junior college teacher.

Appropriately this petition should have been filed by Respondent No.4- Shikshan Sanstha as the proposal is sent by Respondent No.4- Shikshan Sanstha. The learned Counsel for the Petitioners asserts and we accept the statement that Respondent No.4- Shikshan Sanstha is supporting the cause of the Petitioners. As regards whether the proposal is decided or not, the learned AGP states that there are no instructions.

Proceeding on the basis that the proposal is not decided, we direct Respondent No.3- the Deputy Director of Education, if finds that there are certain shortfalls or objections because of which proposal cannot be accepted, to communicate the shortfalls or objections to Respondent No.4- Shikshan Sanstha giving it time to file a reply and to pass a reasoned order upon receipt of the reply from Respondent No.4-Shikshan Sanstha as per law dealing with the explanation given by Respondent No.4-Shikshan Sanstha. 4.
