A report is received from the Addl. Sessions Judge, Palghar. It is submitted that in the present case i.e. in Sessions Case No.57 of 2013, charge was framed on 6.11.2015. The prosecution has examined 10 material witnesses. The 11thwitness is under cross-examination. It is also submitted that the matter has been taken up for hearing on priority basis. It is also submitted that there is no jail facility at Palghar to bring the accused from Thane everyday by the escort and therefore the trial is delayed. 3.
The Superintendent of Central Jail, Thane is hereby directed to keep the accused in Sessions Case No.57 of 2013 present before the Court
Mhi 2 BA-2204-15.sxw on each and every day. In view of this, at this stage, it would not be appropriate to consider an application under Section 439 of Cr.P.C. Application stands disposed of.
