The applicant has been convicted for an offence punishable under Section 3(1)(x) of the Scheduled Caste
* 2/3 * Cri.Appln-1381-2015 (sr.16) & Scheduled Tribes (Prevention of Atrocities) Act and sentenced to suffer rigorous imprisonment for one year and pay a fine of Rs.2,000/-. Equally, he has been convicted under Section 353, 323, 504 and 506 Indian Penal Code and to pay fine of Rs.1,000/- for the offence punishable under Section 353 and Rs.500/- each for the offences punishable under Sections 323, 504 and 506 IPC. IN default of payment of fine, he shall suffer simple imprisonment for a period of 3 months, by the Additional Sessions Judge, Nashik in Special Case No. 27 of 2014. 2.
Heard Mr. Apte, Learned Counsel for the applicant and Mrs. Mulekar, the Learned AGP for the State. Perused the evidence. The applicant was on bail during the pendency of the trial. His sentence was suspended by the Learned Sessions Judge. Considering the facts of the case and since the sentence is for a period of one year, the sentence imposed by the Sessions Court is hereby suspended during the pendency of this appeal and he be released on bail on the same terms with fresh P.R.
* 3/3 * Cri.Appln-1381-2015 (sr.16) Bond in the sum of Rs.10,000/- (Rs. Ten Thousand only). The Application is disposed off accordingly.
