Heard Mr. Tiwari, learned Counsel for the applicant, Mr. Anil Singh, learned Senior Advocate and Mr. Vyas, learned A.S.G. 2.

The applicant has impugned an order dated 24th July, 2017 passed by the learned Special Judge for C.B.I, Greater Bombay by which respondent No.2 herein (Original Accused No.2 in Sessions Case No.177 of 2013; 178 of 2013, 577 of 2013 and 312 of 2014) was discharged.

The same order was also challenged by respondent No.1 - Central Bureau of Investigation by way of another Criminal Revision Application No.206 of 2018 before this Court. The said Criminal Revision Application was dismissed and disposed of on 10th September, 2018 by this Court (Coram: A.M. Badar, J.). 4.

Learned Counsel for the applicant submits that the applicant herein viz: Rubabuddin Shaikh was also a party in Criminal Revision Application No.206 of 2018. Learned Counsel for the applicant and Senior Advocate Mr. Singh are ad idem that the judgment delivered in Criminal Revision Application No.206 of 2018 has attained finality, in the sense, neither the Central Bureau of Investigation nor the applicant herein have challenged the said judgment in the Supreme Court and, therefore, the present revision application has become infructuous. Learned Counsel for the applicant, therefore, submits that the present Criminal Revision Application may be disposed of in view of the aforesaid facts. 5.
