By this Petition under Article 226 of the Constitution of India, the Petitioner challenges an order passed by the Caste Scrutiny Committee.

It is the case of the Petitioner that the Committee did not afford complete opportunity of establishing and proving the claim. The Petitioner claimed to be belonging to "Kunbi Caste" (Other Backward Class) which is recognized as such by the State of Maharashtra.

902.WPL.30686.16 On such a Writ Petition, after hearing the Petitioner and the learned AGP, this Court in Vacation on 1st November, 2016 passed a detailed order. The Court passed an ad-interim order directing the Committee to afford such opportunity and as desired by the Petitioner.

In terms of the order of this Court, the grievance of the Petitioner is redressed. Now, the proceedings before the Committee are scheduled on 23rd November, 2016 and on such date in terms of the directions of this Court, the Committee shall grant an opportunity to the Petitioner to place all materials. The Committee shall consider them while passing the final order. Nothing survives in the Writ Petition and it is disposed off in terms of the order dated 1st November, 2016. This Court clarifies that it has not expressed any opinion on the rival contentions. The order passed on 26th October, 2016 by the Committee and impugned in the Writ Petition is set aside. (B. P.
