DATED : 11th MARCH 2020 P.C:- On the said Civil Application seeking condonation of delay of 142 days in filing the First Appeal, notice came to be issued to the respondent on 14th November 2017. Today, when the Civil Application is listed, none appear for the respondent. Heard learned counsel for the applicant and perused the application seeking condonation of delay. Tilak
2/2 18 CAF 3504-17.doc The cause of delay is sought to be justified on account of the corporate procedure which involve seeking of legal opinion and seeking approval of the appropriate authorities stage wise. It is urged that a good cause raised in the Appeal should not suffer on account of the delay.
On perusal of the application, I am of the opinion that sufficient cause has been shown to condone the delay of 142 days in filing the First Appeal and it deserve to be condoned. Resultantly, Civil Application No.3504 of 2017 is allowed in terms of prayer clause (a).
List the First Appeal after two weeks.
