By this petition, the petitioner seeks a direction to the respondent No.1 to register an offence in respect of robbery and forcible removal of his taxi bearing No. MH01-BT-2614 from the petitioner's driver's custody on 6th October, 2019. 1/3

Mr. Konde Deshmukh, learned Addl. P.P. has submitted a report dated 21st February, 2024 addressed to him by the Senior Police Inspector, Nirmal Nagar Police Station, Mumbai. The said report is taken on record.

From the said report, it appears that the petitioner Charanjit Singh Gill has been informed vide letter dated 7th December, 2019 that the dispute is of a civil nature and as such, his complaint has been filed.

In view of the statement made by Mr. Konde Deshmukh, Addl.P.P., learned Counsel for the petitioner seeks leave to withdraw the petition with liberty to file appropriate proceeding before the appropriate forum/Court, as maintainable in law. 5.

Accordingly, the petition is disposed of with liberty as prayed.

We make it clear that we have not gone into the merits of the petitioner's complaint and as such, all contentions of all parties are kept open.
