CRIMINAL APPELLATE JURISDICTION CRIMINAL WRIT PETITION NO.4492 OF 2014 Mohammed Jameel Merchant Petitioner versus The State of Maharashtra and another Respondents Mr.A.M.Saraogi for Petitioner.
Mr.J.P.Yagnik, APP, for State.

Heard. Learned counsel for the Petitioner submits that he is not getting renewal of the passport as a criminal case is pending against him. It appears that in earlier point of time, the Trial Court had rejected the application of the Petitioner. Aggrieved by that order, the Petitioner filed Criminal Writ Petition No.3598 of 2012. Vide order dated 13 December 2013, a learned Single Judge of this Court disposed of the said writ petition and directed to issue passport to the Petitioner, subject to provisions of Passport Act. 2.
It would be appropriate for the Petitioner, if he makes an application for renewal of his passport to the Trial Court. If such an application is made, the Trial Court would decide the same on its own merits and in accordance with law.
