The applicant is facing accusations in C.R.No.764 of 2022, which invoke Sections 323, 324, 504, 506(2) read with Section 34 of IPC.

Undisputedly, the only Section, which is non-bailable, is Section 506(2) of IPC.

The complaint fled on 04/06/2022 by a civil contractor allege that he was assaulted by three unknown persons. But, in the supplementary statement recorded after four days, the applicant has been named on the basis of the information received by the complainant that he was one of the assailants. Learned A.P.P. has placed on record the injury certifcate which record contused lacerated wound of 1 X0.5 X0.5 cm on M.M.Salgaonkar

In the wake of the aforesaid circumstances, the Investigating Offcer has instructed the learned A.P.P. to make a statement that the custodial interrogation of the applicant is not necessary, but the applicant shall render his co-operation in the investigation. Hence, the following order.

: ORDER :

(a) Application is allowed.

(b) In the event of arrest in connection with C.R.No.764 of 2022 registered with Malad Police Station, applicant-Akhilesh Premnath Singh shall be released on bail on furnishing P.R. Bond to the extent of Rs.25,000/- with one or two sureties in the like amount.

(c) The applicant shall report to the concerned police station on 16th & 17th November, 2022 between 4.00 p.m. to 6.00 p.m. and, thereafter, as and when called for. (d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Offcer and shall not tamper with evidence.
