Learned counsel for the petitioner, after arguing for some time, does not press this petition and seeks leave to withdraw the petition, by keeping all contentions of the petitioner open. He, however, requests that the petitioner be given one last opportunity to cross-examine Dr. Shweta Shah.

Learned counsel for the respondent states that the matter is posted for judgment on 18th March 2020. He submits that this is a High Court expedited matter and as such, no indulgence be granted. Vide order dated 18th October 2019, the petitioner was granted liberty to cross-examine Dr. Shweta Shah on the next scheduled date or seek an adjournment. It is not in dispute that till date, the petitioner has not examined Dr. Shweta Shah.

wp.11064.19.9.doc Learned counsel for the petitioner, on instructions, however, requests that the petitioner be permitted to cross-examine Dr. Shweta Shah on 18th March 2020 through video conferencing. He submits that the petitioner will not seek any adjournment on the said date unless the matter is adjourned by the Court on its own volition. In the interest of justice, the petitioner is permitted to crossexamine Dr. Shweta Shah on 18th March 2019 or on such date, as may be deemed fit by the trial Court. It is made clear that the petitioner shall not take any adjournment on the said date on any count. The trial Court to pass final orders after said cross-examination of the said witness is over. The petition is accordingly disposed of as withdrawn. All contentions of the parties are kept open, including the grounds raised by the petitioner in the present petition.
