Mr. Milan Desai, learned counsel for the petitioner seeks leave to withdraw the petition with liberty to file an appropriate application before the learned Sessions Court, Greater Bombay. He further submits that the petitioner may be protected for a limited period to enable him to file the application.

Leave with liberty is granted. Petition is dismissed as withdrawn. No coercive action be taken against the petitioner for a period of two weeks so as to enable him to file an appropriate application before the Additional Sessions Court, Greater Bombay.

It is made clear that this Court has not gone into the merits of the matter and in the event, any application is filed by the petitioner, the learned Sessions Judge shall decide the same on its own merits and in accordance with the law.
