The Applicant has filed an affidavit dated 12 May 2017 in this Court. In the said affidavit, he has undertaken to deposit an amount of Rs.50,00,000/- before this Court as per the Schedule mentioned therein. It is also stated that the amount deposited by the applicant shall be invested in Fixed Deposit Receipts renewed thereafter till the outcome of the trial before the Magistrate's Court. The first instalment of Rs.10,00,000/- was due on 5 June 2017. However, the said deposit has not been made as stipulated in the affidavit. The learned Advocate for the Applicant undertakes to deposit an amount of Rs.10,00,000/- on or before 13.6.2017.
2 / 3 According to him, the balance amount would be deposited as per the Schedule prescribed in the said affidavit. 2.
Learned Advocate for the Complainant has no objection. However, he submitted that if there is any default, liberty may be granted to approach this Hon'ble Court to recall the order passed by this Court.

In view of the aforesaid undertakings, interim order dated 18.11.2016 is confirmed. Liberty to the Complainant to approach this Court for appropriate reliefs in case of default of undertaking by the applicant.

Both the parties are aggreable that after the entire deposits are made, the said amounts be converted into Fixed Deposit with a nationalized bank for a period of three years. 5.
After the entire amount is deposited by the applicant, the entire deposit be converted into Fixed deposit with any nationalised Bank for a period of three years.
