The present Applicant along with owner of the Spa by name Sun Saloon and Spa Global City are charge-sheeted by Arnala police station in connection with C.R.No.I-160 of 2022. It was registered under section 370 read with 34 of IPC and sections 3, 4 and 5 of The Prevention of Immoral Human Trafficking.

On the basis of secret information received by Anti Trafficking Cell, Vasai, the police have raided said spa, Narangi Bypass Road, Virar (West), Taluka Vasai, District Palghar. They found that there was massage facility available at the spa and it is for male, however, under the pretext of performing massage, the male customers used to have sexual intercourse with females. The present Applicant was found to be the Manager at spa and she was providing all sort of services, so also for arranging services of females. It was disclosed that spa was owned by Shraddha Pawar.

Police have recorded statement of two victims, who had stated that present Applicant used to coordinate in between male customers and females. Furthermore, they have stated that if they will offer the services to male customers, they used to get more money. Statement of two victims are also recorded before the Court of Judicial Magistrate, First Class, under section 164 of the Code of Criminal Procedure. Except stating about facility of massage being arranged, they have not stated that they are making themselves available for sexual abuse by the male customers. 5.
It is claimed that the Applicant has completed a course and she possess a certificate issued by the Maharashtra Technical and Self 2/4
Employment Credit Society. It is on page 146. It is contended that the Applicant is behind bar since May 2022.

Considering the above circumstances, her further detention in the jail is not required. Hence, the following order is passed :
O R D E R
(a) The Applicant-Mrunali Ramdas Devne be released on bail in connection with C.R. No.I-160 of 2022, registered with Arnala Sagari police station for the offences punishable under section 370 read with 34 of IPC and sections 3, 4 and 5 of The Prevention of Immoral Human Trafficking Act, on furnishing personal bond and surety bond of Rs.25,000/-. (b) The Applicant shall not threaten the prosecution witnesses or allure them in any manner.
(c) The Applicant shall cooperate the police as and when required and shall attend the trial Court punctually.
(d) Needless to say, violating of the condition above will make the Applicant liable for cancellation of bail, after notice to the Applicant.

Application is disposed of accordingly.

These are my prima facie observations and the trial Court may not be influenced by that.
