Heard Mr.Gaikwad, learned Counsel for the applicant. He submitted that by order dated 5.7.2016 in C.R.A. No.354/2015, this Court issued notice to the respondents returnable after 12 weeks. The matter was thereafter listed before the Registrar (Judicial-II) on 1.9.2016. Two weeks time was granted to the applicants to supply copies, failing which C.R.A. was to stand dismissed. Mr.Gaikwad submitted that as the copies were not supplied within the stipulated period, C.R.A. was dismissed for non-prosecution. He states that notices were not issued to the respondents as the copies were not supplied.

In view thereof and for the reasons stated in the application, Civil Application is allowed. Order dated 1.9.2016 is recalled and C.R.A. is restored to its original position. List C.R.A. for admission on 28.11.2016.
