Heard learned Counsel for the petitioner.

By this petition under Article 227 of the Constitution of India the Petitioner Plaintiff challenges the order dated 12.01.2014 passed by 4th Joint Civil Judge, Senior Division, Nashik below Exh. 45 in Special Civil Suit No. 79 of 2012 for carrying out appropriate amendment in plaint by adding subsequent purchaser as the defendant.

The Trial Court rejected the plaintiff's application mainly on the ground that as per plaintiff's contention original defendant agreed to sell the suit property to two persons. In spite of that plaintiff has filed application for joining, out of them only one person.

907 wp 10779-14=.doc Considering these facts and the reasons given by the Trial Court in paragraphs 7 & 8 of the impugned order, I do not find any reasons to entertain the present Writ Petition under Article 227 of the Constitution of India.

Hence, Writ Petition stands rejected.
