Applicant's anticipatory bail application No. 7143/2022 was heard by the learned Sessions Judge, Pune on th November, 2022 and has been kept for passing orders on th November, 2022. Applicant's contentions is that, pending application, the learned Sessions Judge has not granted the interim pre-arrest protection, thus this application is moved.

Herein, Crime came be registered against the applicant on 23 rd October, 2022 pursuant to order dated 28 th September, 2022 passed by the JMFC Court-9, Pune in exercise of powers under Section 156(3) Criminal Procedure Code. 3.

That since the learned Sessions Judge had heard the applicant on merits on 10 th November, 2022 and posted the application for passing orders on 17 th November, 2022, I am not inclined to grant this application. However, the learned Sessions Judge shall endeavour to pass the order in the said anticipatory bail application positively, on 17 th November, 2022. It is clarified that, I have not heard the applicant on merits.
