By this application, the applicant seeks pre-arrest bail in connection with C.R. No. I 169 of 2019, registered with Shree Nagar Police Station, Thane for the alleged offences punishable under Section 306 r/w 34 of the Indian Penal Code.

Perused the papers. On 13th September, 2019, deceasedChandrakant Chalke committed suicide in his house, pursuant to which, A.D was registered with the Shree Nagar Police Station, Thane. In the investigation, a chit was found allegedly written by the deceased implicating his wife Shital and the present two applicants (friends of Shital). It is alleged in the said suicide note by the deceased that his wife Shital and the applicants are responsible for ruining his life. This is all what is mentioned in the suicide note. In what manner and how, the applicants had ruined his life has not been mentioned in the suicide note. After one year, the applicants are sought to be arrested, pursuant to the F.I.R lodged by deceased Chandrakant's mother-Sunita Chalke on 11th September, 2019, for the aforesaid offences. Prima facie, it is doubtful whether an offence under section 306 is made out as against the applicants. 4.

In the facts, custodial interrogation of the applicants is not necessary. The application is accordingly allowed and the applicants are granted pre-arrest bail on the following terms and conditions :

ORDER

(i) In the event of the arrest, the applicants be enlarged on bail on furnishing P.R. Bond in the sum of Rs.20,000/- each, with one or two sureties in the like amount ;

3/3 (ii) The applicants shall report to the Investigating Officer of the concerned Police Station as and when called;

The application is disposed of.
