CORAM
:
B.P.DHARMADHIKARI & REVATI MOHITE-DERE, JJ.
DATE :
8th February 2019.
P.C.
Nobody appears for petitioners. Learned APP appears for respondent No.1 and 5. Mr. Kezer Kharawala, appears for respondent No.4. He points out that property mortgaged with respondent No.4 bank is illegally purchased by the petitioners and they are trying to avoid action against the said property for loan recovery.
2] We have perused the prayer clause in the matter. None of the prayer clauses specifically point out any grievance against the
YBG 47-wp-4507-14 creditor bank.
3] Though the matter has been filed some time in November 2014, the petitioners have not obtained any orders of notice to other side.
4] We, therefore, dismiss the petition for want of prosecution.
