It appears that the appeal filed by the petitioners against the rejection of the application for regularization of the unauthorized structure is pending before the State Government from 19th November, 2014, under Section 47 of the Maharashtra Regional and Town Planning Act. Since the appeal is pending since long and the order of status-quo is operating in favour of the petitioners herein, it would be necessary to direct the State Government to decide the appeal within a time frame.
bsb 2 WP10528.14.doc Hence, the writ petition is disposed of with a direction to the State Government to decide the appeal filed by the petitioners as early as possible and positively within a period of three months. The order of status-quo to operate till the appeal is decided by the State Government.
Order accordingly. No order as to costs.
