P.C.:- 1) In pursuance of Order dated 23rd February 2021, learned Incharge Joint C.J.J.D. & J.M.F.C. (Court No.3) Pune through Hon' ble Principal District & Sessions Judge has forwarded its Report dated 3rd March 2021.

1.1) That the said case could not be taken up for adjudication for want of appearance of accused. Prima facie it appears that, as Applicant did not remain present before trial Court, it could not proceed with the hearing of the said RCC No.4684/2017.

2) Be that as it may. As police have already submitted chargesheet and as the case is now ready for framing of charge, learned counsel for Applicant seeks leave to withdraw Application with liberty to 1/2

rsk 46 Apl-1433-2019.doc file an Application for discharge and/or to contest the said RCC No.4684/2017 pending on the file of Joint C.J.J.D. & J.M.F.C. (Court No.3), Pune.

Leave and liberty granted.
