Learned APP appearing for the respondent/State has tendered across a report prepared and signed by the Superintendent of Nashik Road Central Prison, Nashik. The same is taken on record and marked ' X' for identification.

Upon perusal of the contents of the letter written by the petitioner and one another co-accused to the Hon'ble the Chief Justice of this High Court, it appears that the petitioner had prayed for transfer of the investigation to the CBI from Malegaon Police Station in C. R. No. 146 of 2014 for the offences punishable under Sections 302, 447, 323, 504 read with 34 of the Indian Penal Code.

Upon perusal of the report submitted by the Superintendent of Nashik Raod Central Prison, Nashik, it is clear that the petitioner tried and one co-accused and the Sessions Court, Malegaon awarded sentence for the offence leveled against them.

In that view of the matter grievance the petitioner does not survive. Hence, writ petition stand disposed of. 5.
