This is an application for extension of time to surrender. The application for anticipatory bail preferred by the applicant was rejected by this Court on 10th September, 2018. At the request of the learned counsel for the applicant three weeks time was granted to surrender before the Investigating Officer. By order dated 26th September, 2018, time to surrender was extended by one week. This application has been preferred for extension of time to surrender by three weeks on the ground that applicant is required to be admitted in hospital for implant due to fracture and date for admission is fixed on 8th October, 2018 and he will be

Learned APP opposed the extension of time. It is submitted that on the earlier occasion, the time was extended. The applicant is avoiding to surrender and therefore, no further extension shall be granted. It is also submitted that investigation has been stalled due to non arrest of the applicant.

It is pertinent to note that the applicant was apprehending of arrest in connection with C.R. No. 224 of 2017 for the offences punishable under Sections 420, 465, 467, 471 read with 120B r/w 34 of Indian Penal Code. Application for anticipatory bail was rejected by assigning the reasons and with an observation that custodial interrogation of the applicant is necessary. Inspite of that time was granted to the applicant to surrender. In the light of the aforesaid circumstances, further extension cannot be granted. Hence, application stands rejected.
