1] Applicant is apprehending arrest in CR No/312 of 2017 dated 27th November 2017 registered with Nallaso ra Police Station, District Palghar under sections 420 read with 34 of the Indian Penal Code. 2] At the outset, the learned APP submitted that, the applicant is also involved in three other crimes of similar nature. He pointed out the observations made by the Trial Court in paragraph No.8 of the impugned Order.
3] The record indicates that, the allegations against the applicant in the present crime and other other crime are same and similar. It thus appears that the application has inclination towards criminality and when 1/2
aba.2072-2018.doc the applicant was on bail in other crime, the present crime has been registered against him. This ground alone is sufficient to reject the present application for pre-arrest bail.
4] Taking into consideration the antecedents at the discredit of the applicant, this Court is of the view that the applicant doe not deserve to be protected by pre-arrest bail.
Application is accordingly rejected.
