Heard. The learned AGP Mr. Patel filed affidavit in reply dated 2nd April, 2018. Same is taken on record. The learned counsel Mr. Bhavake for the Petitioner submits that in view of subsequent developments i.e. passing of final award dated 7th November, 2015 and the order dated 30th January, 2018, by the Additional Divisional Commissioner, Pune Division, Pune rejecting the Petitioner's application under Section 48 (1) of the Land Acquisition Act, 1894 the Petitioner may be permitted to withdraw the present Aswale 1/2
18.wp.2561.16.doc Petition with liberty to file a fresh Petition challenging the order dated 30th January, 2018 under Section 48 (1) and Award dated 7th November, 2015. To that effect he has given in writing. Same is taken on record and marked "X" for identification. Same is accepted. The Writ Petition stands disposed of as withdrawn with liberty as prayed.
At the request of the learned counsel for the Petitioner, adinterim relief granted by this Court dated 16th May, 2016 to continue till 27th April, 2018.
