Learned counsel for the petitioner fairly submits that the relief prayed for in this writ petition has become infructuous as by the application made before the trial Court a request was made for visitation right during the Diwali vacation. It is made clear that if the fresh application for visitation right/access is made, the trial Court shall not be influenced by the observations made in the impugned order and the application shall be decided afresh on its own merits.

The writ petition stands disposed of as infructuous. No costs.
