The petition challenges the order dated 11th October, 2017 by which the appeal filed by the present petitioners stands dismissed on account of non-fulfillment of the

Undisputedly, vide order dated 21st September, 2017 the petitioner was directed to deposit 50% of the notice amount. The order was also conditional that in the event the first installment was not deposited prior to 1st October, 2017, the Appeal shall stand dismissed. 3.

Undisputedly, the petitioner has failed to deposit the first installment which has resulted into dismissal of the Appeal. The order dated 21st September, 2017 was not challenged by the petitioner and was accepted. In that view of the matter, no case is made out. The Writ Petition is dismissed.
