Heard learned counsel for parties. Petitioner is before us seeking a direction to Respondent Nos. 1 to 4 to treat the date of appointment of the Petitioner as 1 October 1999 on the aided post and accordingly fix his pensionary benefits.. 2.

Petitioner has made request to Respondent Nos. 1 to 4, however, there is no decision thereupon. In light thereof, we dispose of the Petition, directing the Deputy Director of Education to examine the representation made by the Petitioner. If the Deputy Director is satisfied with the case made out by the Petitioner, he should proceed to grant necessary reliefs. If the Y.S.Patil

2 9-WP-16646-2023.doc Deputy Director reaches adverse prima facie opinion, then he will set out the grounds of objections, calling upon the Petitioner to respond the same and after receiving response of the Petitioner, deal with the same and pass a reasoned order within a period of 8 weeks, after receipt of the explanation from the Petitioner, subject to earlier time bound commitments. If the Deputy Director requires any papers from Respondent No. 4/Educational Institution, he can issue necessary directions. Writ Petition is accordingly disposed of.
