Heard learned counsel appearing for the respective parties. The present Civil Application is filed by the Applicant / Original Respondent No. 1 for fixing early date of hearing of the Writ Petition. Both the learned counsel agreed that the Writ Petition deserves to be heard at an early date.

Ms. Gadre, learned counsel appearing for MIDC submitted that the Common Effluent Treatment Plan (CETP) is required to be constructed on the land occupied by the Petitioners.

Perused the Civil Application. For the reasons stated therein and in view of the above submission made by the learned counsel for the Applicant, the Civil Application is allowed in terms of prayer clause (a).

Writ Petition is fixed for hearing on 6th January, 2022 by consent of the parties. Civil Application stands disposed of accordingly.

It is stated that MIDC has filed its reply on 27.01.2017 to the Writ Petition. Learned counsel for the Petitioners submits that he shall consider if any rejoinder is required to be filed or otherwise, if so advised. In the event, if any rejoinder is to be filed, the same shall be done within a period of one week from today. Copy of the same shall be served on the MIDC.
