The counsel for the applicant place reliance upon the order passed on 27/09/2022 in case of co-accused Mohammed Abbas Shaikh @ Mohd. Lefti in (ABA No. 2545 of 2022) and claim parity.

The learned APP state that the investigation is complete

2/3 10 ABA 3116-22 BA 2991-22.doc and the charge-sheet has been filed against the other accused persons, and hence custodial interrogation of the applicant is not necessary and particularly when the role attributed to the coaccused, who is released on bail is identical to the one attributed to the present applicant in the charge-sheet. 3.

In the wake of the aforesaid statement the following order is passed.

: ORDER :

(a) Application is allowed.

(b) In the event of arrest in connection with C.R.No. 884 of 2021 registered with Dharavi Police Station, applicant- Irfan Kamruddin Khan shall be released on bail on furnishing P.R. Bond to the extent of Rs.25,000/- with one or two sureties in the like amount.

(c) The applicant shall report to the concerned police station on 24/11/2022 and 25/11/2022, between 3:00 p.m to 5:00 p.m and thereafter as and when called for. (d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted

3/3 10 ABA 3116-22 BA 2991-22.doc with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence.

In (BA No. 2991 of 2022), though it arises out of the same C.R., the learned APP seek some time, hence list the application for hearing on 25/11/2022.
